Thomas Harding Obtains Malicious Prosecution Judgment and Double Costs

Malicious prosecution cases are difficult. They require more than proving that something went wrong; they require proving a serious misuse of legal process.

In Arsenovski v. Bodin, Thomas Harding acted for the plaintiff in an eight-day malicious prosecution trial. The trial judgment awarded both compensatory and punitive damages.

The plaintiff also obtained double costs after a plaintiff offer to settle. That kind of result shows why strategic offers matter: when the other side refuses a reasonable resolution, the costs consequences can be significant.
